When killing a person brutally is not a hate crime then what is it?

KUANTAN: There is no element of hate crime in the murder of transgender woman Sameera Krishnan.
“We are looking into the victim’s past activities and also whether the murder was linked to a kidnapping case in Klang two years ago.
“We are investigating if it was an act of vengeance but there is no indication that the murder was a hate crime against a transgender individual,” said Pahang CID chief Senior Asst Commissioner Datuk Raja Shahrom Raja Abdullah.
Sameera, 26, was the main witness in her own kidnapping case, which had been set for hearing at the Shah Alam court early next month.
In the 2015 case, she was rescued by police when her captors’ car was involved in an accident with another vehicle at the Sungai Rasau toll plaza.
Early Thursday morning, Sameera was found dead with a gunshot wound and her body mutilated in Jalan Pasar, Kuantan, after she went out to buy food.
Kuantan OCPD Asst Comm Abdul Aziz Salleh said police were taking the case seriously like any other crime.
“The point is someone was murdered so police will investigate this case thoroughly according to procedure as always,” he said.
In Petaling Jaya, the Malaysian Tamil Transwoman Association vice-president Kalaivani Ramasamy lambasted the recent use of the term pondan in certain media reports over Sameera’s murder.
“Pondan refers to men dressed up as women. We are not men dressed up as women, we are transgender women,” said Kalaivani.
She said such crude terms were used because of the general lack of respect for the transgender community.
Transgender activist Nisha Ayub, in a Facebook posting, also criticised those who had used degrading terms to describe Sameera’s gender identity.
Nisha also talked about a local radio station, which had in its morning programme yesterday, referred to Sameera as a transgender man.
Nisha said the announcers, who were giggling, also said Sameera had “changed, was cute but yet was murdered”.

At about 3:30 a.m. on Thursday, a 27-year-old transgender woman, Sameera Krishnan, was brutally murdered in Kuantan city, Malaysia.
Krishnan who worked in a florist shop, was attacked with a knife and received slash wounds to her hands, arm, head, and legs, and was shot up to three times. Reportedly her attackers were three masked men who had arrived in two cars.
Krishnan’s funeral was held on Friday, February 24, which happened to be her birthday.
The police chief of Kuantan, on peninsular Malaysia’s east coast, stated that the authorities have started an investigation into the killing.
Transgender people in Malaysia live in a hostile environment. Malaysia is one of very few countries in the world that prosecutes individuals whose gender identity differs from the sex assigned to them at birth, simply for being who they are.
Historically, transgender people had a high degree of acceptance in Malaysia. But this began to change with a series of state legislative initiatives, beginning in the 1980s, that criminalized transgender people and forced them underground. Under these discriminatory laws, transgender people can be arrested simply for wearing clothing deemed not to pertain to their assigned sex.
In a 2014 report, “I’m Scared to be a Women: Human Rights Abuses Against Transgender People in Malaysia,” Human Rights Watch documented rights violations by state religious officials and police, including arbitrary arrests, detention, sexual assault, and torture, as well as extortion of money and sex. Human Rights Watch also identified instances of violence by private citizens, employment discrimination, and stigmatizing treatment by health workers.
Official crackdowns on transgender people came with a cost. Today, violence, aggression, and discrimination against transgender people in Malaysia are underreported because transgender people – quite understandably – do not trust the police.
The police should work to earn back some of the transgender community’s trust by conducting a thorough and professional investigation into the killing of Sameera Krishnan, and ensuring that the perpetrators are brought to justice.

PETALING JAYA: LGBT activist Nisha Ayub has called for an end to the negative portrayal of transgenders, saying it puts them in danger of being harmed.
“We don’t feel safe in our own country,” she told FMT.
“Look at the way we are portrayed by certain people, religious authorities and certain media. They paint us in a negative light.”
She said the negative portrayal dehumanised the transgender community and conveyed the message that it was all right to harm them.
“A lot of transgender women don’t dare to go out of their homes alone. They’ll go out only in groups.”
She said police reports about attacks on transgender persons were often treated lightly. There has even been instances when the transgender persons making the reports were blamed for the incidents, she added.
“Most of the time, transgender people don’t even want to report an incident to the police because they don’t want to face the whole scenario of being blamed for something that happened to them,” she said.
“When I was attacked in 2015, I was taken so lightly that I had to bring a lawyer friend of mine to the station and only then did the police call it a case.”
In September 2015, two men attacked and injured Nisha with an iron rod while she was on her way to work.
More recently, a transgender in women’s clothing was found dead in Kuantan with three gunshot wounds. According to a Bernama report on Thursday, K Selamperasan, 27, who went by the name Shameera Krishnan, also had several slash wounds.
Police said the attack appeared to be an act of revenge.

Sexual orientation can be changed, Jakim says in new LGBT video
KUALA LUMPUR, Feb 13 — The federal Islamic authorities have suggested that sexual orientation can be changed with extensive training, in a recent video explaining how Muslims can approach the lesbian, gay, bisexual and transgender (LGBT) community.
The 3:08-minute video in Malay language has since received mixed reception from some Malaysians, with several praising it as a softer strategy that does not promote hate against the maligned minority, while others felt it still fails to acknowledge the community.
“Fact is, there are those among Muslims that has non-heterosexual orientation but remains steadfast on the path of Islam.
“For them, this is a test of Allah, and they choose to face the test appropriate with what Islam demands,” said the video shared by social activist Syed Azmi Alhabshi in a public post on his Facebook profile yesterday.
Dr Mohd Izwan Yusof, an assistant senior director of the Islamic Development Department Malaysia’s (Jakim) family, social and community department, corroborated in a separate post that his group was responsible for the video.
In the video, Jakim had likened sexual orientation with horse-riding, claiming that when someone realises that he has “different” orientation from others and wishes to change that orientation, he should receive extensive training and guidance.
Jakim said to change one’s sexual orientation, one must intend to do so for God’s sake instead of being forced and repent one's homosexuality, in addition to leaving activities that would lead to same-sex relations.
It also urged a repentant homosexual to fulfill his sexual desires through marriage, or subdue such desires by among others resorting to fasting.
The video also advised Muslims to be patient, and to help their friends change and return to the straight path, if they discover them to be LGBT.
Conversion therapy which consists of psychological treatment or spiritual counseling to change a person's sexual orientation from homosexual or bisexual to heterosexual is widely seen by medical and scientific community as potentially harmful and a form of pseudoscience.
The practice is opposed and has been legally challenged, or even banned, in countries such as Australia, Brazil, Chile, China, Ecuador, Israel, Lebanon, Malta, South Africa, Switzerland, the United Kingdom and the United States.
In 2014, several medical and gender experts questioned the “success” of Jakim’s spiritual rehabilitation camp for transgenders, insisting they need medical care to transition them into their affirmed gender identities rather than rehabilitation to return them to what some may consider “normal”.
At the time of writing, the video has been watched over 9,000 times, and received positive response from Facebook users on Syed Azmi’s profile.
“Congratulations Jakim for producing a video with no elements of hatred towards the LGBT. I hope Jakim’s missionary department can remind each state to not act rough towards the LGBT,” said a top comment by user Azira Aziz.
“The video's soft approach on advising, respect for privacy and emphasis on free will is definitely commendable. This is far better than saying they're sinners, they're going to hell,” said another top comment by user Luq Harith.
The video however received criticisms for suggesting that homosexuality can be changed, such as by user Sheelabanu Sri Jaya who said, “This video is going to make people believe that there is a way to 'change' homosexuals into heterosexuals. No way you can do that.”
“I was not impressed by the video. And it's very dangerous for them to encourage heterosexual marriage as a way to ‘fix’ the LGBT person, for the person, the spouse AND the children they may bear,” commented user Huda Mutalib.
“Calling for reparative therapy is not exactly good intentions, let alone genuine respect that LGBT people should live their lives the way they want it to be,” added user Zulaikha Mohammad.
