what happened?
A Malaysia for all

JANUARY 1 — The year 2016 has left many of us bruised and battered, emotionally and spiritually, and it is easy to make the mistake of anthropomorphising the year to lay blame at its feet.
There were major celebrity deaths and earth-shattering socio-political upheavals; you would think that 2016 was being unnecessarily cruel to humankind, making it one of the worst years in history.
But alas, 2016 has no mind of its own, nor were the events a deliberate machination of fate. Things just happened.
And in this country, the year 2016 symbolised the start of the deepening fissures that aim to cleave Malaysia in two — a repercussion that we have felt ever since the divisive 2013 general elections.
At the start of the year, I wrote about the rise of Islamisation, and how it has slithered in between the country's governance — not only in the three branches of legislative, executive and judiciary, but also in the civil service.
Year 2016 has not proven me wrong. Instead, the extent to which Islamisation has spread — to the point of ignorance and apathy — has given more ground for the Islamist lobby to exert its influence.
It was the year when Islamists boldly demanded the country be moulded to suit their whims and fancy, and so many of have not only enabled them, but also facilitated the process.
A huge part of this major shift in influence and leverage has been the unofficial collusion of two of the biggest Malay/Muslim-majority political parties in the history of the country: the ruling nationalist Umno, and Islamist opposition PAS.
On the one hand, you have Umno which seems to have given up on the minorities following their massive rejection in 2013. The front page headline of "Apa lagi Cina mahu?" (What more do the Chinese want?) in Malay daily Utusan Malaysia the day after the polls pretty much sums everything up.
The years that followed saw the ethnic Chinese community become much more vocal; they formed the majority at rallies and protests including this year's Bersih 5.
Umno has shifted its focus to not only retain the rural Malay votes, but sway the affection of Malay voters who have been smitten by the Islamist ambition of PAS. And that has meant playing the religion card.
The impotence of the non-Malay component parties in Barisan Nasional has left this unchecked. Not only have Umno leaders made unilateral decisions, but component leaders have been openly shamed by their Umno counterparts.
On the other hand, you have PAS that has slowly shed its social justice focus and purged the so-called progressives from the party in 2015. The dominance of the ulama faction ever since means a shift in focus on the afterlife rather than the elections.
But what has made this collusion so successful is the willingness of both parties to collaborate outside Parliament. That was not really there before. Now largely motivated by the need of its leaders to cling on to power, they are working together under the guise of the unity of the Ummah, or the Muslim community.
It is then that the struggle for the Ummah becomes much bigger and more important, rather than the harmony and prosperity of the plural society.
After such a year, surely 2017 will not be any worse?
The possibility of a general elections in this year, sadly, will not allow such positivity to manifest.
I still predict that the next elections will be the most Islamised yet, with the religious card being wielded left and right — and federal opposition pact Pakatan Harapan would be poorly-equipped to deal with such nasty tricks.
You can bet that the road to the elections will be paved with the race to be the holiest, with takfirism — the accusing other Muslims as infidels — being a powerful weapon.
In the end, the obsession to Islamise the country, aided by the selfish needs of political parties that need to stay in power (and grab power), will divide the country further: not necessarily between Muslims and non-Muslims, but those who wish to submit themselves to an Islamist rule, and those who do not.
The rise of Islamisation will see more Muslims who do not wish to see their lives tainted by non-Muslim elements. There is a wish by them to expand their silo, and at the same time achieve a utopia where everybody submits to the ways of just one religion — something that would inevitably result in a backlash from a plural society.
This should not happen in the first place. Malaysia was formed as a federation of many peoples, of different ethnicities, religions, and cultures. We used to treasure this, so why are we now trying to erase our plurality to fulfil the demands of the Islamist lobby?
We need to heal, to reconcile this society that has been broken along so many lines. But first, in 2017, we have to resist the division.
If anything, there is still time for the liberals and progressives of all stripes to band together as a show of strength. There is a need to organise, to strategise, even if for the few months that is left before the elections.
We need to play the long game — for time is on our side. The future waits where progressive ideas are embraced by more and more people. We will get there, but we need to get there sooner. We need to get there faster, quicker than the rate at which the old ideas are dying.

The group and its allies, which called themselves Justice for Sisters, said the decision wilfully disregards current scientific and medical understanding of gender identity, as well as the realities and lived experiences of transgender people.
“It also displays a wilful ignorance of good practices worldwide with regards to the role of the state in its duty to uphold and protect the rights of transgender persons,” it said in a statement.
“Sex is a biological construct that is usually assigned at birth based on the visible genitalia of a child.
“However, it comprises other aspects, including chromosomes, gonads, secondary sex characteristics and others,” the group added.
The Court of Appeal on January 5 allowed an appeal by the government to set aside a High Court ruling that granted a woman who underwent a gender reassignment surgery to change his identity card details.
A three-judge panel led by Datuk Seri Zakaria Sam reached a unanimous decision, saying there was merit in the National Registration Department (NRD) director-general’s appeal against the 30-year-old respondent who now looks like a man.
But Justice for Sisters argued that gender is a personal identity based on one’s experience of one’s own gender, and not based on societal description.
It also said that sex and gender are both basic characteristics of all human beings and “do not have to be aligned”.
It then argued that by overturning the decision to allow the NRD to mark the transgender’s sexual identity as a man, the person could be liable to discrimination.
“Legal documents, including the NRIC, bearing gender markers that do not reflect the bearer’s gender identity poses systemic and structural discrimination, which severely impedes their quality of life.
“For example, this mismatch poses a constant risk of humiliation and harassment to transgender persons from other people or groups,” it said.
On July 18 last year, the NRD was ordered by the High Court to declare the transgender a man, on grounds that he has a constitutional right to life under Article 5 (1) of the Federal Constitution.
According to past news reports of the ruling, the constitutional concept of “life” accords the transgendered respondent the right to live with dignity as a male and be legally accorded judicial recognition as a male.
The High Court judge presiding the case, S Nantha Balan, also ordered the NRD director-general to change the respondent’s name and last digit on the identity card to reflect his identification with the male gender.
In overturning the High Court ruling, the Court of Appeal supported the NRD’s citation of biological reasons to deny the trans man to be identified as male.
But Justice for Sisters countered that the appellate court’s demand for evidence of medical intervention in order to legally recognise a transgender person’s gender is not only a backdated practice, but exposes a fundamental misunderstanding of transgender people and gender identity.
“Aside from issues of affordability, accessibility to healthcare and legal barriers that impede access to healthcare; fundamentally, gender identity is not determined by our genitals,” it said.
The group then noted that many countries in the world have progressed in recognising transgender rights and urged the judiciary and the National Registration Department to emulate them.
It said countries like Denmark, Malta, Ireland and Argentina have simple legal gender recognition that legally recognises a person’s self-determined gender with a simple declaration.

The Malaysian transgender community and its allies are appalled and disappointed by thedecision of the Court of Appeal on 5th January 2017 to retract the High Court order to the National Registration Department (NRD) to change the name, gender marker and last digit of the identification card number of a trans man in his National Registration Identity Card (NRIC). The decision disregards current scientific and medical understanding of gender identity as well as the realities and lived experiences of transgender people. It also displays a wilful ignorance of good practices worldwide with regards to the role of the state in its duty to uphold and protect the rights of transgender persons.
Sex is a biological construct that is usually assigned at birth based on the visible genitalia of a child. However, it comprises other aspects, including chromosomes, gonads, secondary sex characteristics and others. Gender is a personal identity based on one’s experience of one’s own gender. Sex and gender are both basic characteristics of all human beings and do not have be aligned. Legal documents, including the NRIC, bearing gender markers that do not reflect the bearer’s gender identity poses systemic and structural discrimination, which severely impedes their quality of life. For example, this mismatch poses a constant risk of humiliation and harassment to transgender persons from other people or groups.
Seeking evidence of medical intervention in order to legally recognise a transgender person’s gender is not only a backdated practice, but exposes a fundamental misunderstanding of transgender people and gender identity. Aside from issues of affordability, accessibility to healthcare and legal barriers that impede access to healthcare; fundamentally, gender identity is not determined by our genitals. Withholding legal gender recognition of transgender people except with medical evidence that they have undergone all possible surgical and medical interventions in order to ‘completely’ transition is harmful to well-being of transgender persons, and places trans people at the risk of undergoing unwanted procedures.
On top of that, asking for evidence of chromosomal change is, as quoting Justice S. Nantha Balan who presided over the case at the High Court, “The male XY and female XX chromosome will remain static throughout the individual’s natural life. To insist on the “chromosomal requirement is to ask for the impossible.” Someone who is transgender does not identify with the sex they were assigned with at birth. While there are procedures to closer align external body parts to one’s self-image, science has yet to come up with ways to change one’s gonads or chromosomes. This makes it impossible for Malaysian transgender persons to access their fundamental human right to identity. It is important for the courts and the state agencies to keep themselves updated on current information and scientific knowledge of sex and gender. Our ignorance and lack of understanding cannot perpetuate the marginalization and violence that is so prevalent towards trans people. Most importantly, any discourse of transgender people must be guided by evidence and lived experiences of trans people.
We urge the government, the judiciary and the National Registration Department to look atpractices and policy in countries like Malta, Ireland, Colombia, Argentina and Denmark with regards to legal gender recognition. In these countries, legal gender recognition is a simple and hassle-free administrative procedure that legally recognises a person’s self-determined gender with a simple declaration, without any need for medical or psychological intervention or assessments. While this does not solve all the issues that transgender people face in Malaysia, it will significantly improve the quality of life for transgender people in Malaysia. The National Registration Department must review its current practices and policy in order to reduce harm towards trans people and afford transgender people a greater ability to rightfully participate as part of society.

PUTRAJAYA, Jan 5 — The Court of Appeal today allowed an appeal by the government to set aside a High Court ruling which granted a woman who underwent a gender reassignment surgery to change his identity card details.
In a unanimous decision, a three-judge panel led by Datuk Seri Zakaria Sam said there was merit in the National Registration Department (NRD) director-general’s appeal against the 30-year-old respondent who now looks like a man.
“We have read the submissions and after holding a discussion, we have come to a unanimous decision that there is a merit in the appeal.
“With this, we allow the appeal and set aside the ruling by the High Court,” Zakaria said, adding that the written grounds of judgment will be provided later.
Malay Mail Online is not disclosing the transgender’s identity to protect his privacy.
On July 18 last year, the NRD was ordered by the High Court to declare the transgender a man, on grounds that he has a constitutional right to life under Article 5 (1) of the Federal Constitution.
According to past news reports of the ruling, the constitutional concept of “life” accords the transgendered respondent the right to live with dignity as a male and be legally accorded judicial recognition as a male.
High Court judge S Nantha Balan also directed the NRD director-general to change the respondent’s name and last digit on the identity card to reflect his identification with the male gender.
The judge noted that the respondent who had undergone a gender replacement surgery in Thailand in 2009, had grown up behaving and living like a man, and had obtained the validation of the medical profession that he is a male person.
The High Court judge reportedly added in his ruling that amending his identity card details would avoid confusion following his gender reassignment surgery.
“It all boils down to the quality and persuasiveness of the medical and psychiatric evidence and factual matrix that is presented to the court as the application for a declaration must be for genuine reasons and not for spurious or suspicious reasons.
“In my view, the chromosomal requirement is archaic and should be discarded because scientifically, it is impossible for a biological male to have female chromosomes and vice versa.
“The male XY and female XX chromosome will remain static throughout the individual’s natural life. To insist on the “chromosomal requirement is to ask for the impossible”, Nantha Balan was quoted as saying in his ruling by The Star daily in an August 21 report last year.
Senior Federal Counsel Mohamad Rizal Fadzil, who represented the NRD director-general, in his submission today said the respondent had a duty to show on evidence that all the requirements and standards on the respondent’s sexual conditions and gender reassignment would render his legal status to be changed in consideration of chromosomal, gonadal, genital and psychological factors.
“A medical report was issued after he did the gender reassignment operation in Thailand. No medical report before the sex change surgery.
“The report didn’t state the chromosome, it didn’t say anything about chromosome just physical condition,” Mohamad Rizal told reporters later.
The respondent, represented by counsel William Lim was not present at the Court of Appeal today.
